Why You Still Need a Covid-19 Waiver of Liability

Although lockdowns are finally being lifted in Canada, it unfortunately doesn’t mean COVID-19 has disappeared. The government now allows in-person fitness classes, small businesses, and patios to open – so it’s off to the races, right?! Well, hold your horses because medical research is showing that the new variants such as Delta, are more contagious than ever and even vaccinated people are contracting COVID-19.

If your business thrives in-person and you are eager to get back ‘normal’, whatever that may look like to you, a COVID-19 Waiver of Liability is a MUST! This waiver explains to participants that you will be following the government guidelines on COVID-19 and that you cannot be held legally liable in the event that participants are exposed to, or contract the virus.

This Waiver of Liability also shifts responsibility to your participants, ensuring they understand how contagious and life threatening COVID-19 can be, while having them agree to social distancing policies and government guidelines at your event or session. The Waiver of Liability also requires the participant to attest that:

  • They are not experiencing any COVID-19 symptoms
  • They have not travelled internationally in the past 14 days
  • They do not believe to have been exposed to the virus
  • They have not recently been diagnosed with COVID-19
  • They are following government guidelines and limiting their exposure

This waiver is also governed by the Province or State in which the in-person event takes place to prevent any confusion.

The best part about this waiver?

This waiver can be modified to comply with your own COVID-19 precautions, especially if you wish to enforce more strict regulations for your participants’ safety. For example, you can mandate an over-the-nose mask requirement (if it’s not legally required where you are), require a certain kind of mask (i.e. two-ply with no exhalation valve), and even require participants to be fully-vaccinated.

This waiver of liability protects you and your participants both legally and (hopefully) physically!
